1. Acceptance of these terms
By accessing or using freebutnotfree.com you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use the site.
2. What we are, and what we are not
Free But Not Free LLC is a private company providing electronic monitoring and home detention services in Maryland. We are not a government agency, a court, a law enforcement body, a bail bond company, or a law firm.
Nothing on this website is legal advice, and using this site or contacting us does not create an attorney-client relationship. If you need advice about a criminal case, a release condition or a violation, speak to a licensed attorney.
3. Use of this website
You may use this site for lawful purposes only. You agree not to:
- Submit false, misleading or fraudulent information, or impersonate another person.
- Attempt to gain unauthorised access to any part of the site or our systems.
- Interfere with the operation of the site, including by introducing malicious code or automated scraping that burdens our servers.
- Use the site to harass, threaten or infringe the rights of others.
We may suspend or block access where we reasonably believe this section has been breached.
4. Enquiries and referrals
Website forms are provided for convenience. Submissions are transmitted over the internet and, while we take reasonable precautions, no transmission is completely secure. Do not send sensitive medical, financial or privileged material through a website form; contact us and we will provide an appropriate channel.
By submitting a referral you confirm that you are authorised to share the information you provide and that it is accurate to the best of your knowledge.
Submitting a form does not create a contract, does not guarantee a response within any particular time, and should never be relied on for an urgent matter. For anything urgent, call (667) 334-8139.
5. No guarantee of enrolment or release
An enquiry or referral does not create a supervision agreement and does not guarantee enrolment. Enrolment requires authorisation from the court or supervising agency, a completed intake, verification of the proposed residence, suitability of the equipment for that location, capacity on our part, and confirmed payment arrangements.
We do not control custody or release decisions and we make no representation about the outcome of any legal proceeding. Nothing we say about eligibility or timing should be treated as a prediction of what a court will do.
6. Governing documents
The specific terms of a monitoring programme — the conditions supervised, programme rules, fees, payment obligations and the duration of supervision — are governed by the applicable court or agency order together with the service agreement signed at intake.
Where there is a conflict, the following order of precedence applies:
- The court or agency order;
- The signed service agreement;
- These Terms of Service.
7. Participant responsibilities
A participant enrolled in one of our programmes agrees to:
- Comply with every condition of the order and with the programme rules provided at orientation.
- Keep the device charged in line with the instructions given, and remain in a location where it can charge as required.
- Refrain from removing, tampering with, damaging, shielding or otherwise interfering with the equipment.
- Remain at the approved residence except during approved leave, and follow approved schedules exactly.
- Request schedule changes in advance through counsel or the supervising authority — not after the fact.
- Report equipment problems immediately by telephone.
- Provide accurate address, employment and contact information and notify us promptly of any change.
- Allow reasonable access for installation, inspection, service and removal of equipment.
Failure to meet these obligations may be recorded and reported as a violation.
8. Equipment
Monitoring equipment remains the property of Free But Not Free LLC or its supplier at all times. It is provided for use during the supervision period only and must be returned on completion or termination of the programme.
The participant, or the party identified as responsible at intake, is liable for the repair or replacement cost of equipment that is lost, stolen, damaged beyond normal wear, tampered with, or not returned. Charges for this are set out in the service agreement.
Normal wear and genuine equipment faults are not chargeable, and are documented as faults rather than violations.
9. Fees and payment
Fees, deposits, billing frequency and any payment plan are set out in the service agreement provided before enrolment. Fees are for the monitoring service itself and are payable regardless of the outcome of the underlying case.
Non-payment may result in suspension or termination of service under section 11. Where an order requires monitoring, we will notify the supervising authority before service ends so the court is not left unaware that supervision has stopped.
10. Reporting and disclosure
By enrolling, a participant acknowledges and agrees that information generated by the programme — including location history, curfew and schedule events, device and tamper data, testing results and violation reports — will be disclosed to the court, the supervising agency and counsel of record as the order requires.
We report accurately and promptly, including information unfavourable to the participant, and we do not amend or withhold compliance information at the request of a participant or a family member. See section 6 of our Privacy Policy.
11. Suspension and termination
We may suspend or terminate services where: the court or supervising agency directs it; the service agreement is breached, including by non-payment; equipment is tampered with or not returned; the residence becomes unsuitable or unsafe for installation or service; a participant or household member threatens or endangers our staff; or continuing would require us to act unlawfully.
Termination of our service does not alter the participant's obligations under the court order. Where we terminate, we notify the supervising authority and counsel of record.
12. Service availability
Monitoring depends on satellite, cellular and internet infrastructure operated by third parties. Coverage gaps, network outages, power failures, severe weather, device faults and interference can occur and are outside our control.
We monitor continuously and respond to faults as quickly as reasonably practicable, but we do not warrant uninterrupted, error-free or continuously available service, and we do not guarantee that every event will be captured in real time. Our website is likewise provided on an "as available" basis.
13. Not a security or protection service
Electronic monitoring records and reports information about a participant's location and compliance. It is a supervision and documentation tool.
It is not a security service, an alarm service, a personal protection service, or a guarantee of any person's behaviour or safety. We do not intervene physically, we are not an emergency service, and we do not undertake to prevent any act by a participant or any third party. Anyone in immediate danger should call 911.
14. Intellectual property
All content on this website, including text, graphics, illustrations, the Free But Not Free name, the FBNF mark and our logo, is owned by Free But Not Free LLC or its licensors and is protected by law. You may not copy, reproduce, distribute or create derivative works from it without our prior written permission, other than ordinary personal use of the site.
15. Third-party links and content
This site links to and embeds third-party resources, including a mapping service. We do not control that content and are not responsible for it. Links do not imply endorsement.
16. Disclaimers
The website and its content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make reasonable efforts to keep information on this site accurate and current but do not warrant that it is complete, accurate or up to date.
Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited.
17. Limitation of liability
To the fullest extent permitted by Maryland law, Free But Not Free LLC and its members, officers, employees and agents will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost opportunity, or loss of data, arising out of or relating to your use of this website.
Liability arising from the monitoring services themselves is governed by the limitation of liability provision in the signed service agreement.
18. Indemnification
You agree to indemnify and hold harmless Free But Not Free LLC and its members, officers, employees and agents from any claim, loss, liability or expense, including reasonable legal fees, arising from your breach of these terms, your misuse of this website, or information you submit that you were not authorised to share.
19. Governing law and venue
These terms are governed by the laws of the State of Maryland, without regard to its conflict of law rules. Any dispute arising out of or relating to these terms or this website will be brought exclusively in the state or federal courts located in Baltimore City, Maryland, and you consent to the jurisdiction of those courts.
20. Changes to these terms
We may revise these terms at any time. The revised version takes effect when posted, and the "last updated" date at the top of this page will change. Continuing to use the site after that constitutes acceptance of the revised terms.
